Buying from Deluisio Angus
Sale terms
These terms apply when you buy an animal directly from Deluisio Angus. They follow the American Angus Association’s Suggested Sale Terms and Conditions (effective June 5, 2025), with the changes described here. An auction or a specific sale may have its own terms, and those apply to that sale. Questions: call or text Cody at 412-752-6487.
Registration and transfer
- Every animal is sold registered with the American Angus Association and matches its registration certificate.
- Each animal carries a readable identification mark (tattoo, brand or similar) that matches its registration. Check the marks when you take possession and tell us right away about any mismatch.
- When we use a nickname, we also give the official registered name and number.
- We transfer the registration to you at no charge within 45 days after payment is received in full. Payment counts as received once checks have cleared and any bank block or hold has been released.
- AI service certificates are the buyer’s responsibility unless we say otherwise.
Pedigree, performance and genetic information
- The pedigree, performance data and genetic information in our listings are accurate. EPDs and other American Angus Association data carry an “as of” date, because they change with every evaluation.
- Before a sale we tell you about any positive carrier test result on the animal, and about any potential-carrier designation on its pedigree, for genetic conditions the Association recognizes.
- We generally DNA test only potential embryo donors. For other animals, condition status comes from the pedigree, and a pedigree with no carrier designation does not prove an animal is not a carrier.
- Any guarantee about genetic conditions is agreed with you individually.
Health
Talk to us before the sale about the health papers and tests your destination requires. Unless we announce otherwise, we guarantee that animals are eligible for interstate shipment under applicable federal and state regulations.
Breeding guarantees
- Bulls are fertility tested only when the listing or auction says so.
- For animals sold as breeders, we guarantee breeding soundness for six months from the sale. The guarantee does not cover negligence or mistreatment of the animal, problems caused by transportation, or disease contracted after the sale.
- Calves under 12 months old are not guaranteed as breeders.
- “Safe in calf” means a competent veterinarian or reproductive technician has confirmed the pregnancy. “Served” and “pasture-bred” females are not guaranteed to be in calf. “Open” females are guaranteed to be without calf. Cows sold with a calf at side are presumed to be breeders.
- A female used in an embryo transfer program is not guaranteed to be a breeder after the sale unless we agree otherwise, and we disclose that use before the sale.
If something is wrong
- Send your claim to us in writing, at [email protected], with the animal’s registration number.
- Most claims must reach us within 180 days of the sale. Claims about a female sold safe in calf that is not in calf or was bred to a different bull, or about a calf that is not the sex we represented, must reach us within one year. Claims that an animal has incorrect parentage must reach us within two years.
- For a non-breeder within the guarantee, the animal comes back to our farm in good condition and meeting our state’s health requirements. You may then choose a credit toward a future purchase, a replacement animal of equal value (subject to your approval), or a refund. If you ask for a refund, we may either refund the full price or use up to 180 days after the animal’s return to show that it is a breeder.
- For a female sold safe in calf that is not in calf or was bred to a different bull, an animal that turns out to be ineligible for registration for a reason other than parentage, an animal with incorrect parentage, or a calf of the wrong sex, we make a satisfactory adjustment on the price or, at your option, refund the price when the animal is returned to our farm.
- A female sold open that proves to be in calf may be returned before calving for a full refund or an animal of equal value, at our expense.
- Our liability never exceeds the original selling price of the animal.
Payment
- Sales are for cash unless credit arrangements, including any security interest we reserve, are agreed with us before the sale.
- Payment methods and any deposit are agreed with us before the sale.
Delivery and risk
- Risk of loss and injury passes to you as soon as the animal is sold.
- We feed and care for a sold animal at no charge until it is loaded, or until 24 hours after the sale, whichever comes first.
- You arrange and pay for transportation unless we agree otherwise in writing.
Terms that apply to every sale
- If a written listing or an announcement for a specific sale differs from this page, the listing or announcement controls for that sale.
- These terms are a contract between buyer and seller for each animal, and each sale is a separate transaction.
- Except for the guarantees stated here, we make no other warranties, express or implied, including any warranty of merchantability or fitness for a particular purpose. The remedies here are the buyer’s only remedies, and we are not liable for incidental, indirect, special, consequential, punitive or exemplary damages.
- The American Angus Association is not a party to any sale and takes no responsibility for it.
- The law of the state where the sale takes place governs. For a sale at our farm, that is Pennsylvania.
